Your privacy is important to us. As part of our efforts to facilitate and make your experience with Theorem Spatial Intelligence, LLC (“Theorem”), as effective and user-friendly as possible, we may collect and use certain information, directly or indirectly, through the use of our technology, our website, applications, and Platform (collectively, the “Website”).  This Privacy Policy addresses the collection, use, and disclosure of information that Theorem may gather (“Data”) during your use of our Website, any licensed or “white label” usage of FOLIO, and all associated other services you may receive from us (the “Services”). Please review the contents to learn the types of visitor and user information Theorem gathers, how Theorem uses that information, what information is disclosed and to what third parties, and how Theorem safeguards your information.

What Information Does Theorem Spatial Intelligence Collect?

When registering and purchasing with our Website or through third-party payment collection applications or other third party interfaces, we may collect your name, billing address, shipping address, phone number, e-mail address and other demographic information, in order to provide you Services. When you visit our Website at a later date to use Services or to place subsequent orders, we can save you time by providing your previous account information for you. We may also use this information to curate the products, design images, and other items to enhance your experience.  Furthermore, the collection of your email address allows us, or others using the Website potentially, to communicate, ideate, and otherwise update you about activities, new products or services, and general communications as it relates to our Services, user profiles including, but not limited to, images and products added to your account, the status of projects, orders, design or visual surveys, and more. With your consent, we will also use the email address to send our email newsletter and other marketing collateral informing you of news and our other special offers. You are welcome to visit our Website without providing any of this information; however, your use of our Services and the benefits of our expertise will be greatly limited; you will not be able to register as a user nor manage projects without this information.

Standard procedures for the recording and storing of system-identifyable information, to include IP address and geolocation/geocoding data and third-party assimilation and aggregation of this data are covered in subsequent sections of this Privacy Policy.  All information described in this section entitled “What information does Theorem Spatial Intelligence collect?” constitutes “Data” for purposes of this Privacy Policy.

How Does Theorem Use the Collected Data?

We use the Data collected from you primarily to communicate about various things related to your FOLIO account, projects, to notify you of certain items, to send our e-mail newsletter, or to send you targeted marketing information, special product offers, catalogs or other information that we believe might interest you. In every such e-mail, we will have instructions on how to unsubscribe from non-essential communications and avoid receiving any further, non-transactional communications from us. We maintain a holistic record of your Data by compiling system assimilated data with our in-person, phone and/or external communications in order to serve you better. 

Communications from Theorem to You

We may contact you by e-mail to respond to customer service, technical, or design questions you have submitted, or to address a problem affecting your use of the Website, or to send you a confirmation message upon completion of the account registration process. We may contact you by email, text, or phone about certain items, to update you on the status of anything related to the Website. Unrelated to purchase transactions and with your choice to opt-in, we will send you our e-mail newsletter, targeted marketing information, special product offers, catalogs or other information related to and of interest to your previous interactions.

With Whom Does Theorem Share Information?

As part of our commitment to your privacy, Theorem adheres to the guidelines and practices adopted by the Direct Marketing Association’s “Privacy Promise to American Consumers.” We periodically make information, including aggregated information, available to selected third parties, including but not limited to those who share information for direct marketing purposes. We may disclose your Data to a third party if we believe in good faith that the law or legal process requires it, to protect the rights or property of Theorem or others, or as otherwise described in this Privacy Policy.

Notwithstanding any other provision, we may also engage a third-party partner for the purpose of identifying users and delivering to them interest-based content and advertisements. We may share information about you with our partners such as a non-human-readable form of your email or other identifier to ensure the security of your information. Our partners also may collect information directly from your device, such as your IP address, device ID, and information about your browser or operating system; may combine our personal and non-personal information about you with information from other sources; and may place or recognize a unique cookie on your browser. How Is Your Information Protected?

The Website has security measures in place to prevent the loss, misuse and alteration of the information under our control. All orders are transmitted over secure Internet connections using SSL (Secure Sockets Layer) encryption technology. All your personal information are stored in encrypted format. A fingerprint of your password is stored on our system. The Website, and more importantly all user information, is further protected by a multi-layer firewall-based security and industry leading technologies.

Opt Out Policy

If you would prefer not to receive our non-essential communications, newsletter or other marketing forms of communication, you may use the remove functionality located at the bottom of each newsletter or send an e-mail to info@theoremsi.com with “UNSUBSCRIBE” in the subject line. Please be sure to e-mail us from the address that you want removed and include any other email addresses that you want removed.  If you are a business or agency and wish to have your domain listed, please note this may impact future interactions with our sites and services.

Correcting and Updating Your Information

Users of the Website and Services can modify their account information directly in the FOLIO by visiting their Client Profile page. For issues accessing your Client Profile page or modifying your records, please contact us at info@theoremsi.com.

Leaving our site(s) ends our protection of your data.  We are not liable for any third party transactions or activities should you choose to engage.  You should exercise caution and look at the privacy statement applicable to the website in question.

Theorem is not bound by the CCPA 2020 Act, as Theorem does not have nexus in the State of California and does NOT meet a direct to consumer threshold as set forth in the CCPA 2020. If you have enabled privacy controls on your browser (such as a plugin), we have to take that as a valid request to opt-out. Therefore we would not be able to track your activity through the Website. This may affect our ability to personalize ads according to your preferences.
